The petitioner was an approved Assistant Teacher of Mohanbati Parbati Debi Balika Bidyalaya (H.S.), Uttar Dinajpur. The petitioner is complaining delay in disbursement of her retiral benefits.

While deciding the said complaint, a relevant incidental issue had cropped up as to whether the petitioner, on July 03, 1982, had tendered resignation from her service.

To decide the said incidental issue, the District Inspector of Schools (SE), Uttar Dinajpur, the respondent no. 4 herein was directed to hold a meeting with the representative of the petitioner and the school authorities and to file a report before this Court.

Mr. Mandal, learned counsel for the State, in compliance with the said direction, files the said report of the respondent no. 4, let it be kept with the record.

The report speaks that the petitioner has admitted that such resignation was tendered by her.

In view of the said admission, the petitioner is not entitled to the relief as prayed for, W.P.A. 6722 of 2023 is accordingly dismissed without any order as to costs.
