1. Affidavit of service filed in Court today is taken on record.

2. The petitioner's prayer seeking refund of the balance amount of the sale proceed is pending consideration before the Bank.

3. Without entering into the merit of the said application made by the petitioner, the instant writ petition is disposed of by directing the respondent no.2 to consider the prayer of the petitioner in accordance with law and in line with the direction passed by the learned Debts Recovery Tribunal - 3, Kolkata on 13th January, 2016 in T. S. A. No.28 of 2014 (arising out of S. A. No.810 of 2014 of DRT-2)

at the earliest but positively within a period of six weeks from the date of communication of this order.

4. If the prayer of the petitioner is accepted, then necessary payment shall be released in favour of the petitioner without any delay.

5. Learned advocate for the petitioner is directed to forward a copy of the representation dated 29th November, 20254 along with a copy of the judgment passed by the learned Debts Recovery Tribunal on 13th January, 2016 to the aforesaid respondent at the time of communicating the order of this Court.

6. The writ petition stands disposed of.
