Learned counsel for the petitioner submitted that the prayer made in the present petition has been rendered infructuous as far as the challenge in the order of transfer is concerned.

However, considering the fact that the petitioner had been working at the original place of posting in view of the interim stay granted by the Central Administrative Tribunal, the period deserves to be regularised.

In view of the submissions made by the learned counsel for the petitioner, the present petition is dismissed as infructuous regarding challenge to the order of transfer is concerned. As far as the relief regarding the regularisation of the period during which the petitioners did not join at the transferred place of posting on

account of interim stay granted by the Tribunal, let the matter be first examined by the competent authority in the department.

This exercise will be completed within a period of three months from the date of receipt of copy of this order.
