Matter relates to transfer of a petitioner being an Assistant Teacher in a Government aided school on medical ground. The learned advocate for the petitioner submits that on 2nd November, 2021, a transfer application was preferred by the petitioner and the same was processed by the school Authority where petitioner is presently serving and it was forwarded to the office of the concerned District Inspector of School (S.E.) for taking further step. Placing reliance on document at Page 18 of the writ petition it has also been submitted that District Inspector of Schools after taking necessary steps forwarded the transfer application of the petitioner on

17th February, 2022 to the office of the West Bengal Central School Service Commission for taking final decision. Petitioner prays for direction upon the commission to decide the transfer application. West Bengal Central School Service Commission is represented by learned Advocate who submits perhaps due to suspension of Utsashree Portal with effect from 29th September, 2022 contemporaneous decision could not be taken on the transfer application of the petitioner.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the Chairman of the West Bengal Central School Service Commission, being respondent no.3 to decide the transfer application of the petitioner in accordance with law by four weeks from the date of communication of this order and the said decision shall be communicated to the petitioner by one week thereafter.

However, it is made clear that transfer application of the petitioner shall not be rejected on the ground of suspension of Utsashree Portal. There shall be no order as to costs.

Urgent photostat certified copy of this order if applied for be supplied for the parties subject to compliance with all requisite formalities.
