The petitioner is charged with offences punishable under Sections 376(3)/506 of the Indian Penal Code read with Section 6 of Protection of Children from Sexual Offences Act.

We have seen the material in the case diary including statement of the victim girl who was fifteen years old at the time of the incident, recorded under Section 164 of the Code of Criminal Procedure. The victim girl unequivocally says

that one Dinesh and the present petitioner raped her under threat. We have also considered the Medical Report and the same prima facie appears to be consistent with the victim girl's statement.

Although charge sheet has been filed, in view of the gravity of the offence and the extent of incriminating material on record, we are not inclined to entertain the petitioner's prayer for bail at this stage.

Accordingly, CRM 2669 of 2021 is dismissed.
