By the present writ petition the petitioner seeks for consideration of his representation dated 7th February, 2022 submitted before the appropriate authority for appointment of the petitioner on compassionate ground.

The petitioner contends that his father Late Priyagopal Mazumdar joined as an Assistant Teacher in Kundrisole Primary School, P.O. Hoomgarh, District Paschim Medinipur on 2nd February, 2000. The petitioner's father died in-harness on 13th March, 2010 leaving behind his widow (mother of the petitioner), and two minor sons namely the petitioner herein, and one Nibedan Mazumdar. On 19th May, 2010 the mother of the petitioner namely, Suchitra Shill (Mazumdar) submitted an application before the respondent authorities seeking for compassionate

appointment for the untimely death of her husband. On 4th August, 2011 pension payment order was issued in favour of the mother of the petitioner. However, the mother of the petitioner suddenly died on 27th April, 2017. At the time of death of his mother, the petitioner was aged about 16 years. Pension payment order was issued in favour of the petitioner on 3rd October, 2018. Upon attaining majority the petitioner made an application on 7th February, 2022 seeking for his appointment on compassionate ground. However, the same is still pending consideration. Hence, this writ petition.

Mr. Soumak Bera, learned Advocate for the petitioner submits that the matter be relegated to the appropriate authority to take a decision on the application of the petitioner dated 7th February, 2022 seeking for compassionate appointment.

Mr. Ranjan Saha, learned Advocate for the District Primary School Council, Paschim Medinipur, concedes to such submission. He further indicates that in the event the matter is sent to appropriate authority for due consideration, the DPSC would not file any report. 5.

In view of the submission advanced, respondent no.4, Chairman, DPSC, Paschim Medinipur is directed to consider the application of the petitioner dated 7th February, 2022 and dispose of the same, in accordance with law, upon notice to the petitioner, within a period of six weeks from the date of communication of this order.

The reasoned order shall be communicated to the petitioner one week thereof.

Petitioner is directed to serve the copy of this order upon Chairman, District Primary School Council, Paschim Medinipur, respondent no.4, for necessary compliance.

With the above direction, the writ petition being WPA 6527 of 2025 stands disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

10. Interim order, if any, stands vacated.

11. All connected applications, if any, stand disposed of.

12. There shall be no order as to costs.

13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

14. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
