The only prayer of the writ petitioner is for a direction on the District Magistrate, Chinsurah, Hooghly to proceed and dispose of an application dated 11th December, 2020 made by the petitioner under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The letter written by the petitioner to the District Magistrate on 11th December, 2020 shows that the application was filed in 19th September, 2019. Learned counsel appearing for the State respondents prays that an appropriate direction may be given on the District Magistrate, Chinsurah, Hooghly. The point of maintainability to the action taken by the
Bank as pointed out by learned counsel appearing for the private respondent may very well be taken by the private respondent once it is proceeded with by the District Magistrate, Hooghly.
W.P.A.7492 of 2021 is accordingly disposed of with a direction on the District Magistrate, Chinsurah, Hooghly being the respondent no.2 to dispose of the application filed by the petitioner within a period of three weeks from date. The petitioner and the private respondent shall be get informed by the matter. (Moushumi Bhattacharya, J.)
