20.06.2022 Sl. No.67 srm W.P.A. No. 5315 of 2018 Smt. Sandhya Dolui & Anr.

Versus

The State of West Bengal & Ors.

Mr. Keshab Chandra Das, Ms. Aparajita Mondal, Mr. Biplab Adak ...for the Petitioners.

Mr. Ansar Mandal, Mr. Hasibul Islam ...for the State-respondents.

Despite service, none appears on behalf of the respondent Nos.4 and 5. Affidavit-of-service is taken on record. The police authorities have not filed any report, although directed by the Court on an earlier occasion, by an order dated September 13, 2019. The petitioners have alleged torture by the respondent Nos.5 and 6. Further allegation of ouster from the property has also been made. It is alleged that the police authorities have not taken any steps despite several complaints. A complaint was addressed to the Officer-in-Charge, Joypur Police Station, Howrah, which is annexed to the writ petition as Annexure P-4. A complaint was also lodged before the Superintendent of Police, Howrah, but to no avail. Under such circumstances, the writ petition is disposed of with a direction upon the Superintendent of Police, Howrah to

ensure that the complaint lodged by the petitioners is disposed of in accordance with law.

Needless to mention, expeditious steps must be taken by the police authorities in this regard.

This Court has not gone into the merits of the allegation and the same is left open for determination by the investigating agency.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
