Affidavit-of-service filed on behalf of the petitioner is taken on record.

Matter relates to transfer of the petitioner on the ground of distance in between the present school of the petitioner and her place of residence. The learned advocate representing the petitioner on placing reliance on a document at page 17 of the writ petition submits that application for transfer of the petitioner was made on 18th September, 2022 and the same was forwarded to the concerned District Inspector of Schools (SE), South 24 Parganas being respondent no.4. Though from the document at page 17 it cannot be ascertained whether the transfer

application of the petitioner has been forwarded to the respondent no.4 or not but it is submitted on behalf of the petitioner that he has received instruction that meanwhile the transfer application of the petitioner has been forwarded by the school authority.

State respondents and the West Bengal Central School Service Commission are represented by learned advocates.

It has been submitted on behalf of the State respondents that if the transfer application is forwarded to the respondent no.4 by the school authority where petitioner is presently serving in that event direction can be given upon the respondent no.4 to take steps on the transfer application of the petitioner in accordance with law. Accordingly, the writ petition stands disposed of directing the respondent no.4 to take steps based on the transfer application of the petitioner dated 18th September, 2022, if the same has been forwarded by the school authority to the respondent no.4. In the event the transfer application is lying in the office of the respondent no.4, steps shall be taken in accordance with law by four weeks from the date of communication of this order.

However, it is made clear that suspension of Utsashree portal shall not be a ground for rejecting the transfer application of the petitioner. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
