Considering the prayer of learned advocate appearing for the petitioner that he wants to withdraw this petition and avail the remedy of filing appeal against the impugned re-assessment order in question before the Commissioner of Customs (Appeals) under Section 128 of the Customs Act and considering such prayer of the learned advocate appearing for the petitioner this writ petition is dismissed as withdrawn with liberty to file appeal accordingly within two weeks from date and if such appeal is filed before the appellate authority within the time stipulated herein the appellate authority will take a lenient view on the issue of limitation.

With this observation no further order is needed to be passed in this writ petition being WPA 6261 of 2022.
