The complaint case was initiated in the year 2006 and till date the arguments of the case is yet to be completed. The provisions of the Negotiable Instruments Act were amended with the purpose that litigants are protected from the delay happening in the civil court. The present case has taken time to the understanding of the court more than what is required by the civil court to complete a litigation. Learned advocate for the petitioner submits that he intends to examine a defence witness. The defence witness commenced in the year 2013. The learned trial court granted umpteen opportunities and instead of the same, the defence witness could not be completed. The learned trial court thereafter proceeded to the next stage of the case fixing for final arguments and the same is pending since 2019. Having regard to the period of time which has elapsed in the

meantime, I am of the opinion that no further time can be afforded to the petitioner when the trial court has refused such prayer in all its fairness.

As such, no interference is called for. Accordingly, the revisional application being CRR 1178 of 2022 is dismissed. All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
