Mr. Sounak Bhattacharyya, Mr. Sumitava Chakraborty, Mr. Bijoy Bag ...for the petitioner Mr. Amitabh Shukla, Mr. Prabhat Chandra Pandy ...for the WBSEDCL Learned counsel appearing for the petitioner contends that despite several representations of the petitioner, which were given allegedly during the installation of a transformer immediately adjacent to the boundary wall of the petitioner, the WBSEDCL installed the same and has not taken any steps to remove the said transformer, thereby creating safety hazards to the life and limb of the petitioner and other people in the locality.

Learned counsel appearing for the WBSEDCL submits that the petitioner has already made representations and there is no objection on the part of

the Distribution Licensee to consider such representations.

In such view of the matter, W.P.A. No. 6269 of 2022 is disposed of by directing the WBSEDCL to consider the representations of the writ petitioners dated March 23, 2022, March 25, 2022 and March 31, 2022, as annexed to the present writ petition, as expeditiously as possible, preferably within three weeks from date.

In the event the WBSEDCL does not accede to the request of the petitioner to shift the transformer to any alternative location, the WBSEDCL shall refer the matter to the concerned District Magistrate for a resolution of the same, as expeditiously after taking a decision in the matter as possible.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
