Allowed C.R.M.(A) 1012 of 2025 In Re:- An application for anticipatory bail under Section 482 of the BNSS, 2023 in connection with Ranitala Police Station Case No. 455 of 2024 dated 17.07.2024 under Sections 10 of the Prohibition of Child Marriage Act and Section 6/17 of the POCSO Act pending before the learned Judge, Special Court under POCSO Act, Lalbagh, Murshidabad. And In Re : Isabul Sk. @ Ijabul Sk.

...... petitioner Mr. Jisan Iqbal Hossain ...for the petitioner Ms. Nandini Chatterjee ...for the State Apparently, the petitioner entered into a marriage with the lady when she was 15 years of age. Police complaint was lodged about 2 and 1/2 years after from the date marriage. She is presently more than 17 years of age.

Police filed charge sheet.

In such circumstances, we grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482(2) B.N.S.S. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate

order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
