Allowed C.R.M.(A) 1013 of 2025 In Re:- An application for anticipatory bail under Section 482 of the BNSS, 2023 in connection with Berhampore Police Station Case No. 1523 of 2024 dated 07.10.2024 under Sections 20(b)/29 of the NDPS Act and Section 25(1B) of the Arms Act pending before the learned Judge, Special Court under NDPS Act, Berhampore, Murshidabad.

And In Re : Prosenjit Shil @ Raja Shil ...... petitioner Mr. Jisan Iqbal Hossain ...for the petitioner Mr. Joydeep Roy Ms. Sreetama Das ...for the State Police seized contraband which is below the commercial quantity.

Name of the petitioner transpired from the statement of the co-accused made while in custody.

In such circumstances, we grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482(2) B.N.S.S. The petitioner will report before the Investigating Officer once a fortnight till the conclusion of the investigation. The petitioner shall appear on every date before the Jurisdictional Court on

and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
