The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Palashipara Police Station Case No. 368 of 2020 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act.

Learned Advocate for the petitioner submits that no contraband was recovered from the exclusive possession of the petitioner and he has been implicated in connection with the instant case on the basis of the statement of the co-accused. In view of the above, we think that the petitioner has been able to make out a case for taking exception of Section 37 of the Narcotic Drugs and Psychotropic Substances Act.

The prayer for bail of the petitioner is thus allowed. Accordingly, the petitioner, Sohel Rana Dafadar, shall be released on bail upon furnishing a bond of Rs.10,000 /- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Judge, N.D.P.S. Act, Nadia at Krishnagar subject to the condition that the petitioner shall neither leave the jurisdiction of the concerned Police Station without prior leave of the Court nor shall tamper the evidence or intimidate the witnesses in any way.

In default of compliance of any conditions as stated above, it is

open to the learned Special Judge to pass appropriate order without further reference to this Court.

The application for bail, being CRM 2691 of 2021, is thus disposed of.
