The petitioner is the widow of Abdul Jabar who was appointed as the Secretary of Kalinagar Gram Panchayat with effect from September 22, 1980 and superannuated on March 31, 2016. He was granted provisional pension after his superannuation. He expired on August 16, 2024. The petitioner applied for family pension before the Block Development Officer, Ranninagar, Murshidabad on September 19, 2024 which has not been considered as yet. It appears from the report submitted by the State that admittedly under the DCRB Scheme, 1985, the wife of the deceased employee is eligible for family pension. However, such pension has not been settled in favour of the petitioner due to want of specific Government order in this regard.

In view thereof, this Court is inclined to hold that since the application seeking pension filed by the petitioner is pending, the Block Development Officer, Ranninagar-II Development Block, being the 6th respondent herein, be directed to consider and dispose of the application submitted by the petitioner dated September 19, 2024 within two weeks from the date of communication of this order upon granting reasonable opportunity of hearing to the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the application is decided in favour of the petitioner, necessary steps be taken for disbursement of family pension along with arrears at the earliest. The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
