Mr. Dipanjan Dutta Ms. Rupsha Chakraborty ... For the State. The grievance of the petitioner is directed against non-consideration of a representation dated 9th January, 2024.

Briefly, it is alleged that though the petitioner had given his land for a State Project to the Nadia Zilla Parishad, the State respondents have chosen not to make any payment of consideration to the petitioner for wrongful use and acquisition of the petitioner's land. It is further alleged that the price of the above land was fixed at an amount of Rs.5,22,44,577/-. It is also alleged that the price payable was agreed upon by and between the concerned Zilla Parishad and the petitioner. In such circumstances, the State is duty bound to pay make S.D.

payment of the above consideration to the petitioner. On behalf of the State, it is submitted that they have no objection if the representation of the petitioner

dated 9th January, 2024 is considered in accordance with law and disposed of within a fixed period.

On behalf of the Zilla Parishad it is submitted that if the State makes payment of the said amount to the concerned Zilla Parishad, the concerned Zilla Parishad shall make payment to the petitioner.

In view of the above submission made on behalf of the parties, W.P.A. 7154 of 2024 stands disposed of by directing the respondent no. 4 to consider the representation dated 9th January, 2024 in accordance with law and within a period of eight weeks from the date of communications of this order.

It is made clear that there has been no adjudication on the merits of the case and the respondent no. 4 is to act in accordance with law uninfluenced by any observation made in this order.

The respondent no. 4 shall give a notice to all the affected parties and pass a reasoned order after granting an opportunity of hearing to the parties. With the above directions, WPA 7154 of 2024 stands disposed of.

The Statement of Facts filed on behalf of the State respondents be kept with the records.

A copy of the same be also furnished to the parties for consideration.
