Heard Mr. Banerjee, learned advocate appearing for the petitioner and Mr. Chatterjee, learned advocate appearing for the respondents/applicants. Let the documents, as placed, by Mr. Banerjee and the affidavits, exchanged by the parties, be kept on record.

Challenging inter alia an order of transfer dated 21st November, 2008, the petitioner preferred an original application, being OA 159 of 2009. The said original application was dismissed by an order dated 8th January, 2010. Aggrieved by the said order, the petitioner preferred the present writ petition, being WPCT 55 of 2010 in which an interim order was passed on 19th March, 2010, staying the order of transfer dated 21st November, 2008 and subsequent release order dated 12th January, 2009. For vacating the said interim order, a vacating application, being IA No.: CAN 1 of 2023 was filed by the respondents.

Records further reveal that during pendency of the present writ petition, the petitioner was issued an order of transfer which he duly complied with and joined the transferred post. Thereafter, the petitioner was again transferred by an order dated 27th May, 2022. The same was also complied with by the petitioner and he joined the transferred post and is working in the same till date. In view of the above facts, the first order of transfer dated 21st November, 2008 and the release order dated 12th January, 2009 have become infructuous.

In view thereof, no further order is required to be passed in the present writ petition and the same being WPCT 55 of 2010 along with the vacating application being IA No.: CAN 1 of 2023 are, accordingly, disposed of. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
