Halder, Mr. Indranil Halder ...for the Petitioner Mr. Subir Sanyal, Dr. Madhusudan Saha Roy ...for CESC It appears that a provisional order of assessment in the 10-06-2025 AKG Ct. 15 present case was issued on March 8, 2025. Although not specifically pleaded, the petitioner challenges the findings of the provisional assessment, particularly with respect to the determination of the connected load at 10 KW. Mr. Subir Sanyal, learned advocate appearing on behalf of the Calcutta Electricity Supply Corporation, submits that a final order of assessment was subsequently passed on March 27, 2025. He further states that the petitioner failed to appear before the assessing officer despite the issuance of three consecutive notices.

Mr. Bidyut Kr. Halder, learned advocate representing the petitioner, disputes the service of these notices upon his client.

Without delving into the merits of this contention, I consider it just and appropriate to grant the petitioner a final opportunity to appear before the assessing officer and present his objections regarding the connected load. Accordingly, the assessment order dated March 27, 2025, is

hereby set aside.

The petitioner is directed to appear before the assessing officer on June 16, 2025, at 2:00 p.m., whereupon the assessing officer shall provide the petitioner with an opportunity to be heard and shall thereafter issue a fresh final order of assessment in accordance with law. The final order of assessment shall be communicated to the petitioner immediately.

Accordingly, WPA 6573 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
