1. Affidavit of service filed by the petitioner are taken on record.

2. Report submitted by the State is taken on record.

3. The petitioner prays for setting aside or cancelling the marriage registration certificate issued by the Marriage Registrar on the ground that the said Registrar did not have the jurisdiction to register the marriage.

4. Supplementary affidavit filed by the petitioner annexing copy of the West Bengal Hindu Marriage Registration Rules, 2010 is taken on record.

5. Learned advocate representing the petitioner is unable to show any provision which permits the Registrar to cancel the certificate once the same has been issued.

6. It appears that a civil suit seeking annulment of the marriage is under challenge before the learned Court.

Accordingly, no useful purpose will be served by keeping the writ petition pending.

Cancellation of the marriage certificate will be the consequential step in the event marriage is set aside or annulled by the Court.

7. In view of the above, the Court is not inclined to exercise jurisdiction in the matter. The writ petition fails and is hereby dismissed.

8. It will be open to the petitioner to raise all issues before the learned Court where the suit is pending.

9. Urgent certified photocopy of this order, if applied for, be supplied to the parties or their advocates on record expeditiously on compliance of usual legal formalities.
