Learned advocate for the petitioner submits that the subject matter of challenge is the order dated 22.11.2022 passed by the learned Sessions Judge, Purba Burdwan in Criminal Miscellaneous Case No. 2953 of 2022. The said order was anticipatory bail. Subsequently, the accused person surrendered before the jurisdictional court being the learned Additional Chief Judicial Magistrate, Katwa and was released on bail. The petitioner accordingly prays for not pressing the present application for cancellation of bail and a liberty for filing fresh application for cancellation.
Thus, the application for cancellation of bail being CRM(SB) 55 of 2023 is dismissed as not pressed.
Petitioner is granted liberty to take out an application in respect of the subsequent order of bail so granted.
