The petitioner is one of several accused persons. Grave charges have been brought against the accused persons including that of attempted murder and charges under the Arms Act.

The petitioner says that four of the accused persons have been granted bail, two by the learned Trial Court and other two by this Court. He says that he stands on the same

footing as the other accused persons who have been granted bail. The petitioner is in custody for more than two years. We have seen the material in the case diary including the seizure list. Arms and ammunitions were seized from the petitioner. The petitioner was arrested from Jharkhand. Several criminal cases under various provisions of law are pending against this petitioner. There is likelihood of this person absconding if granted bail.

On an overall assessment of the facts and circumstances of the case and the material on record, we are of the view that the petitioner does not stand on the same footing as the other accused persons who have been granted bail.

We are not inclined to allow the prayer of the petitioner at this stage.

Accordingly, CRM 2705 of 2021 is dismissed.
