Calcutta Electric Supply Corporation and others Dr. Madhusudan Saha Roy ...for the CESC Limited.
None appears for the petitioner, although the CESC Limited is represented through counsel.
It is rightly pointed out by learned counsel for the CESC Limited that the application for new electricity connection of the petitioner was refused by the CESC Limited vide letter dated September 16, 2020 (Annexure P-2 at page 19 of the writ petition), inter alia, on the ground of apprehended splitting of load.
Since it is the Grievance Redressal Officer (GRO) concerned who is the appropriate authority to hear such matter, WPA No. 7536 of 2021 is disposed of with liberty to the petitioner to approach the concerned GRO in accordance with law and subject to the law of limitation.
If so approached, the GRO shall decide the issue upon considering the question of limitation as expeditiously as possible, upon giving opportunity of hearing to all concerned. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
