Learned Advocate appearing for the State draws the attention to the statement of an eye witness recorded under Section 164 of the Code of Criminal Procedure. The eye witness names the petitioner as one of the assailants. Considering the materials in the case diary and the statement of the eye witness recorded under Section 164 of the Code of Criminal Procedure implicating the petitioner in the incident, we are unable to grant bail to the petitioner.
