The writ petition is disposed of with a direction upon the Assistant Registrar of Cooperative Societies to dispose of the representation of the petitioner dated January 30, 2024, in accordance with law. The petitioner complains that the fund transfer order for a sum of Rs.3,18, 56,072/-, for supply of materials to 217 numbers of beneficiaries under the scheme had not been allowed to the petitioner by the competent authority.

Learned advocate for the State respondents submits that until the Assistant Registrar of Cooperative Societies furnishes the completion report of the works undertaken by the petitioner as per the work orders and under the relevant schemes, the District Magistrate and the District Programme Coordinator, MGNREGA cannot take any action.

Thus, the Assistant Registrar of Cooperative Societies will call the petitioner for a hearing and dispose of the said representation, in accordance with law.

The authority will decide whether the petitioner is entitled to grant of fund transfer in accordance with the scheme, keeping in view that the specific contention of the State respondents is that all the beneficiaries who were required to be supplied the horticulture materials as per the work order issued to the petitioner, had not been supplied with the same.

The decision shall be arrived at within eight weeks from the date of communication of this order, upon hearing the petitioner. A reasoned order shall be passed and communicated to all concerned.

The writ petition is accordingly disposed of. There shall be no order as to costs.

All parties are to act on the basis of server copy of this order.
