Petitioner running FPS business having licnece No.233800600018. He did not receive the commission from the authority since June 2023 till February 2025. He made a representation to the authority but his representation was not considered. Hence this writ petition.

Ms. Sonal Sinha, learned counsel appearing on behalf of the State respondent submits a separate proceeding has been initiated against the present petitioner. She placed the order sheet of the concerned authority dated February 18, 2025. It appears to me that the proceeding initiated by the concerned authority and order thereunder dated February 18, 2025 is separate to that of the issue raised before the instant writ Court. However, if the commission of the petitioner is due since June 2023 to February 2025, the concerned authority must remit the same according to law.

However, I think it appropriate to direct the Joint Director of Ration, Hooghly, Food & Supply being the respondent no.3 of the instant writ petition to disposed of the representation of the petitioner dated February 10, 2025(P-3 of the instant writ petition) within six weeks from the date of communication of this order. The respondent no.3 shall disposed of the representation according to law after giving an opportunity of being heard to the petitioner. The petitioner is at leave to submit necessary document at the time of hearing.

The decision of the concerned authority shall be communicated to the petitioner within two weeks thereafter.

Under the above observation, the instant writ petition is disposed of.

Since no affidavits are exchanged between the parties, the allegation made in the writ petition shall be deemed to have been not admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
