Ganesh Dey Mr. Anil Kumar Chattopadhyaya ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 6th Court at Howrah to dispose of the misc. case under Order 9, Rule 13 of the Code of Civil Procedure being Miscellaneous Case No.78 of 2024 expeditiously. In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocates representing the opposite party before the learned Trial Judge.

From the order sheets appended to this application this Court finds that the Presiding Officer was transferred and the learned Civil Judge (Jr. Div.), 4th Court, Howrah is in charge.

Mr. Chattapadhyaya, learned advocate appearing for the petitioner submits that the hearing of the

miscellaneous case, which was fixed on March 25, 2025 has been fixed on August 19, 2025. He further submits that the regular Presiding Officer has also joined in the meantime.

In the light of the above submissions made by Mr. Chattapadhyaya, learned advocate for the petitioner CO 1045 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 6th Court at Howrah to dispose of the Miscellaneous Case No.78 of 2024 as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
