The writ petition was disposed of by the order dated March 30, 2023.

Mr. Bhattacharyya, learned Senior Counsel for the petitioner, submits that in the order dated March 30, 2023 due to wrong averment in the writ petition, the date of superannuation of the petitioner has been wrongly recorded, therefore the said order dated March 30, 2023 be recalled and leave may be granted to the petitioner to withdraw the writ petition with liberty to file afresh.

The writ petition since has been disposed of, there is no scope for correction of the said order dated March 30, 2023, however as prayed for, the said order is recalled, in consequence, the writ petition is restored to its original file and number.

The prayer of the petitioner to withdraw the writ petition is allowed, consequently WPA 6812 of 2023 is dismissed as withdrawn without any order as costs. This order, however, will not prevent the petitioner to file a fresh writ petition for the similar relief on the selfsame cause of action.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
