Learned advocate appearing for the petitioners submits that the petitioners are in custody for more than seven months and there has been recovery allegedly from the joint possession of the petitioners of 20.726 kg of ganja. Charge-sheet has already been submitted, as such further detention of the petitioner is unwarranted. Learned advocate for the State opposes the prayer for bail and submits that the seizure was videographed in presence of independent witnesses and next date fixed for consideration of charges. I have taken into account the charge-sheet wherein the prosecution proposes to rely upon 13 witnesses. Having considered that some time will be required by the prosecution to conclude the trial, I am of the view that further detention of the petitioners is unwarranted. As such, the prayer for bail of the petitioners is allowed.

Accordingly, petitioners namely, Rahim Chowdhury and Goutam Adhikary shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act, Krishnagar, Nadia.

If on bail, the petitioners shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) 536 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
