This appeal is arising out of an order dated 21st February, 2019 by which the learned Trial Court refused to extend the interim order after noticing that the plaintiff has misrepresented payment by producing a false cheque. Moreover, the Trial Court has taken into consideration that an application under Sections 5 and 8 of the Arbitration and Conciliation Act is pending. On the reasoning that there is a deliberate attempt on the part of the appellant to mislead the Court, we do not find any reason to interfere with the order of the learned Trial Court.

Accordingly, the appeal being FMA 1012 of 2019 and the application being CAN 1 of 2019 (Old No: CAN 2922 of 2019) stand dismissed.

However, there shall be no order as to costs. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Ajoy Kumar Mukherjee, J.) (Soumen Sen, J.)
