Pathak Mr. Souvik Maji ...for the respondent no. 5 Learned advocate appearing for the petitioner submits that the petitioner has challenged the award of the arbitrator dated September 6, 2024 before the Cooperative Tribunal but due to lack of quorum on account of unavailability of the judicial member, the stay application filed by the petitioner could not be taken up for hearing by the Tribunal.

Learned advocate appearing for the privaterespondents submits that the hearing of the stay application is fixed on April 2, 2026.

In reply learned advocate appearing for the petitioner submits that the 5th respondent is taking steps for execution of the award of the arbitrator dated September 6, 2024.

Since the petitioner has already approached the Tribunal, this Court feels that the interest of justice would be subserved if the Tribunal is directed to dispose of the stay application expeditiously. This Court accordingly directs the Cooperative Tribunal to fix a date of hearing of the stay application and make an endeavor to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

Learned advocate appearing for the respondent no. 5, upon instruction, submits that the 5th respondent shall not take any further step to proceed with the execution proceeding till the stay application filed by the petitioner is disposed of by the tribunal. Such submission of the learned advocate appearing for the respondent no. 5 is placed on record.

With the above observations and directions this writ petition stands disposed of.
