Mr. Nandy submits that records have been traced. The only issue relates to the formal FIR, which is difficult to be traced. A copy of the same is available with the office of the Circle Inspector.

Ld. advocate undertakes that preferably in course of this day, the FIR will be tagged along with the records of the case from the office of the Circle Inspector. If there are any difficulties, in that case, a photocopy of the FIR and the complaint certified by the concerned officer, would be submitted before the Court. No further stretching of time should be allowed for commitment of the case.

Needless to state that this is a case of the year 2010 and almost 12 years have been passed and the commitment is yet to take place.

Having considered the present stage of the case, which has been facing stagnancy, I direct that the officer-incharge of English Bazar P.S. will inform the accused persons to be present in Court on 4th of December, 2023. The ld. trial court either on 4th December, 2023 or within three days thereafter would commit the case to the court of the ld. Sessions, after supply of all the relevant documents.

The ld. Sessions Court would take steps either by trying the case itself or delegate the same to any Additional Sessions Judge, who will, at the earliest, consider the issue relating to the charges and fix at least three dates in a week for the purposes of the present case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

The report of the Ld. Registrar Judicial Service, High Court, Calcutta, be kept with the record.

The report submitted by the officer of English Bazar P.S. be also kept with the record.

With the aforesaid observations, CRR 1007 of 2023 is disposed of.

Pending application, if any, is also disposed of.
