Mr. Samiran Giri, Mr. Khairul Alam For the State :
Mr. Sk. Md. Galib, Snr. Govt. Adv., Ms. Priyamvada Singh Heard on :
31.03.2026 Judgment on :
31.03.2026 Sabyasachi Bhattacharyya, J.:-
1. The present application has been filed for expeditious disposal of OA 2630 of 2022 (LRTT) and the connected applications, which are now pending before the Fourth Bench of the West Bengal Land Reforms and Tenancy Tribunal.
2. The learned Senior Government Advocate points out that a supplementary affidavit sought to be filed by the petitioner before the Tribunal has not yet been served, despite the last recorded order of the Tribunal, on the State, nor has the petitioner filed any affidavit-in-reply
to the opposition filed by the State to the condonation application of the petitioner.
3. Learned counsel for the writ petitioner submits that the writ petitioner shall not file any reply to the opposition filed against the condonation application and proceed on the basis of the materials already on record to argue the condonation application before the Tribunal. It is further submitted that a copy of the supplementary affidavit has been served on the State in the meantime.
4. Be that as it may, we find that the Original Application and the connected applications are pending since the year 2022 and that long dates are being fixed in the matter.
5. Accordingly, this Court is of the opinion that the matter should be heard out expeditiously.
6. Hence, WPLRT 66 of 2026 is disposed of by requesting the Fourth Bench, West Bengal Land Reforms and Tenancy Tribunal to dispose of all pending applications in connection with OA 2630 of 2022 (LRTT) as expeditiously as possible, positively within two months from the date of communication of this judgment to the Tribunal.
7. It is expected that the main Original Application itself shall be disposed of, of course, subject to the outcome of the condonation application, as expeditiously thereafter as possible, positively by the end of this year.
8. There will be no order as to costs.
9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.) I agree.
