1. The petitioners are aggrieved by an order dated 05.03.2024 passed by the ACP, Howrah asking them to take an alternative route to hold a rally and procession to converge at the Nabanna Bus Stand. The ACP, Howrah has also suggested a different venue for convergence of the petitioners.

2. The petitioners have indicated that they wish to take route from Howrah Rail Museum via Vivekananda Setu - Howrah Maidan - G. T. Road - Kazipara Crossing to Nabanna Bus Stand.

3. The learned Advocate General has submitted that there is some congestion in the route proposed by the petitioners.

4. Having heard counsel for the parties, this Court is of the view that since the petitioners have undertaken before this Court to hold peaceful rally on their

proposed route, they should be allowed to hold their rally and meeting.

5. The petitioners shall follow a single line in their rally without causing any obstruction whatsoever to any traffic and vehicular of movement. The petitioners shall be bound by any other usual terms and conditions that may be stipulated by the Howrah Police.

6. Although the petitioners have proposed persons, they shall try to restrict the number.

7. The writ petition is disposed of.

8. There will be no order as to costs.

9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
