C.R.M. (DB) 1066 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baruipur Police Station Case No. 959 of 2022 dated 02.06.2022 under Sections 498A/326A/307 of the Indian Penal Code. And In Re :

Mainul Sardar ... Petitioner Mr. Saibal Mondal Ms. Sonali Ghosh ... for the Petitioner Mr. Md. Adil Badr Ms. Trina Mitra ....for the State Heard learned counsels for the parties.

Petitioner is in custody for about three years and prays for bail.

Learned counsel for the petitioner submits that there has been little progress in trial after his bail prayer was rejected earlier.

Learned counsel for the State opposes the prayer. I have perused the material on record.

The petitioner has been seen at the place of occurrence by the victim as well as neighbours. The medical evidence supports the contention of the victim. Offences, if proved, shall attract mandatory life imprisonment.

Considering the material on record prima facie suggesting active involvement of the petitioner in the crime, prayer for bail is rejected at this stage.

The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The bail application is disposed of.

Case Diary is returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
