Learned advocate appearing for the petitioner submits that the private-respondents have been duly served.

In spite of service none appears for the privaterespondents. State is represented by Mr. Mahata, learned AGP.

The present grievance of the petitioner is that the order of the Sub-Divisional Magistrate and SubDivisional Officer, Haldia dated August 28, 2025 directing the private-respondents to remove unauthorized encroachment caused by them from the

plot of land in question, i.e., LR 467 of Mouza 3rd Part Jalpai, JL 157 under Nandigram Police Station in the district of Purba Medinipur, has not yet been executed/implemented.

Learned advocate appearing for the petitioner submits that in spite of making several requests the respondent authorities are sitting tight over the matter and have not taken any step to remove the encroachment. In support of such contention the learned advocate appearing for the petitioner draws the attention of the Court to a memo dated February 16, 2026 issued by the Sub-Divisional Officer, Etamogra Irrigation Sub-Division, Mahishadal, Purba Medinipur.

Mr. Mahata, learned AGP, submits that the Inspector in-Charge of Nandigram Police Station, Purba Medinipur has given a written instruction to him that due to ensuing Assembly Election 2026, the police authorities are not in a position to provide necessary assistance for the purpose of execution of the order directing removal of encroachment. He further submits that necessary assistance shall be provided for eviction after completion of the election.

The said letter is taken on record. A copy of such letter is handed over to the learned advocate appearing for the petitioner.

This writ petition stands disposed of by directing the Inspector in-Charge, Nandigram Police Station, being the 8th respondent, to fix a date when necessary police assistance shall be given to the respondent authorities for execution of the order of eviction. Such date shall be fixed on or before the end of the month of May, 2026. The respondent authorities are directed to execute the order of removal of encroachment by the end of the month of May, 2026.

The 8th respondent shall communicate the said date well in advance to the respondent nos. 3, 4 and 5 herein.
