At the time of hearing Ld. Lawyer for the appellant by filing a copy of death certificate in respect of the appellant Dibyendu Banerjee who died on 04.07.2022 submits that the appellant being the sole appellant in this case, having died the appeal shall abate on the death of the accused/appellant.

Ld. Lawyer for the convict/appellant further submits that the near relatives of the convict/appellant do not wish to proceed in this case as per the proviso to Section 394 of the Code of Criminal Procedure. In view of the said fact the appeal abates and thus is accordingly disposed of. (Shampa Dutt (Paul), J.)
