Case (Arbitration) no. 17 of 2018 under Section 34 of the Arbitration and Conciliation Act, 1996 pending before the learned Additional District Judge, 3rd Court, Alipore, 24 Parganas (South) is the ultimate relief, as sought for in this case. Learned advocate for the petitioner submits that the petitioner has already been favoured with an award.

Because of the pendency of this Miscellaneous case, no execution proceeding has yet been set in motion.

The only contention expressed by the learned advocate for the petitioner is against the delay caused in the disposal of Miscellaneous case, referred hereinabove.

No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary.

The service upon the opposite party is thus dispensed with, so far as the present revisional application is concerned.

Accordingly, the learned Additional District Judge, 3rd Court, Alipore, 24 Parganas (South) in Misc. Case (Arbitration) no. 17 of 2018 is requested to ensure expeditious disposal of pending Misc. Case, referred hereinabove, providing sufficient opportunities of hearing to both the parties, but without granting any unnecessary adjournment to either of the parties, unless it is extremely unavoidable.

The petitioner is directed to communicate this order to the learned Court below, opposite party and their advocates as well.

With this directions and observations, this revisional application stands disposed of.

Urgent photostat certified copy of this order duly applied for, be given to the parties upon compliance of all requisite formalities.
