Mr. Siddhartha Lahiri Mr. Debraj Dutta ...for the petitioners A direction to secure expeditious disposal of Misc. Case (Arbitration) no. 2 of 2021 now pending before the learned Additional District Judge, 11th Court, Alipore is the ultimate relief, as sought for in this case.

The only contention expressed by the learned advocate for the petitioners is that the court below has not yet disposed of an application under Section 36(2) of the Arbitration and Conciliation Act, 1996 by granting stay of operation of the award.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary.

The service upon the opposite party is thus dispensed with, so far as the present revisional application is concerned.

Accordingly, the learned Additional District Judge, 11th Court, Alipore, in Misc.

Case

(Arbitration) no. 2 of 2021 is requested to ensure expeditious disposal of pending Misc. Case referred hereinabove, providing sufficient opportunities of hearing to both the parties, but without granting any unnecessary adjournment to either of the parties, unless it is extremely unavoidable.

While endeavouring such exercise, the formalities of the law, if any required to be observed, may be ensured in accordance with the provisions of law.

The petitioners are directed to communicate this order to the learned Court below, opposite party and their advocates as well.

With this directions and observations, this revisional application stands disposed of.

Urgent photostat certified copy of this order duly applied for, be given to the parties upon compliance of all requisite formalities.
