Union Of India & ANR v. Ahiram Mishra
26.09.2023 Ct. No. 11 rrc WP.CT. 66 of 2012 (Union of India & Ors. Vs. Ahiram Mishra) Mr. Sarajit Sen Mr. Tapas Singha Roy ..... For the respondent The present writ petition has been preferred challenging an order dated 26th August, 2011 passed by the learned Tribunal in an original application being OA No. 1051 of 2009.
The matter last appeared before this Court on 22nd August, 2023 when none appeared on behalf of the petitioners in spite of notice. To give a last opportunity to the petitioners to appear and contest, the matter was adjourned with a direction upon the respondent to intimate the said order to the learned advocate, who had entered appearance on behalf of the petitioners and also to the petitioner nos. 1 and 2 and to file an affidavit-ofservice. Pursuant to the said order, service has been effected but no one appears even today on behalf of the petitioners and no accommodation has been sought for. It appears that the petitioners are not interested in the matter any further. Let the affidavit-of-service, as filed, be kept on record.
In view thereof, the writ petition being WP.CT. 66 of 2012 is dismissed and the interim order is vacated.
There shall, however, be no order as to costs. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Partha Sarathi Chatterjee, J.) (Tapabrata Chakraborty, J.)
