21.12.2020 Sdas rejected C.R.M. 3100 of 2020 with CRAN 1 of 2020 (Old CRAN 1489 of 2020) (via video conference) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Murshidabad Police Station Case No. 592 of 2016 dated 21.12.2016 under Section 21(c) of the N.D.P.S. Act.
And In Re : Sukuruddin Sk. .... petitioner Mr. Robiul Islam ....for the petitioner Mr. N. Ahmed Ms. Z. N. Khan Mr. M.F.A. Begg ...... for the State Petitioner undertakes to affirm and stamp the petition/application as per Rules within one month of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conferencing.
The application being C.R.A.N. 1 of 2020 (Old CRAN 1489 of 2020 is disposed of.
Statements of the witnesses disclose prima facie involvement of the petitioner in dealing in narcotic substance above commercial quantity.
Under such circumstances and in view of the statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected.
Trial court is directed to expedite the trial and to conclude the same without granting any unnecessary adjournment to either of the parties.
