Re: CAN 2 of 2021 This application is filed for modification of the order dated 20.04.2021 by which the respondent No.1 was directed to deposit a sum of Rs.1.50 crores with the Trial Court within a period of one week from date.

It is submitted on behalf of the learned Counsel for respondent No.1/plaintiff that due to ongoing pandemic situation for the 2nd phase of the Novel Corona Virus (Covid19), the Court concerned is not functional and in this regard he has relied upon a resolution passed by the Bar Association at Barasat Court dated 21st April, 2021. In view of the aforesaid, we modify our order only to the extent that instead of depositing a sum of Rs.1.50 crores with the Trial Court, the respondent No.1/plaintiff shall deposit the said sum on or before 30th April, 2021 with the learned Registrar General of this Court who shall remit the

said amount to the learned Civil Judge (Senior Division), 2nd Court at Barasat, North 24 Parganas within a fortnight thereafter. The other directions contained in the previous order shall remain unchanged.

The application being CAN 2 of 2021 stand disposed of.

The department shall record disposal of the appeal and the application in terms of the order dated 20th April, 2021 and the said matter shall not be shown as pending.
