In this regard under the Death-cum-Retirement Benefit Scheme, the Secretary of the School Education Department has the power to condone the shortfall in service.

Therefore, I direct the Secretary of the School Education Department to give a hearing to the petitioner within a period of six weeks from the date of communication of this order and to pass a reasoned order by two weeks thereafter and to communicate the same to the petitioner by a week thereafter.

With the above observation and direction, this writ application is disposed of.
