In terms of the order dated 3rd April, 2025 a report of the District Inspector of Schools (S.E.), South 24 Parganas dated 22nd April, 2025 is filed by the learned Senior Advocate representing the State respondents and same is taken on record.

On perusal of the report it appears that petitioner is an Assistant Teacher of Sanskrit in normal section whereas another Assistant Teacher of Sanskrit in Higher Secondary section is working in the same school. Therefore, petitioner ought not to be considered as a single teacher of Sanskrit in the said school.

But while considering the prayer of the petitioner for transfer, Court finds that roll strength of the school in question is 1525 whereas 25 teachers including petitioner are working. Therefore, present pupil teacher ratio is 61:1 in the school in question which is much beyond prescribed limit of 40:1.

Petitioner made a prayer for transfer on the ground of distance in between the present school of the petitioner and his place of residence. Therefore, Court finds pupil teacher ratio is a relevant consideration while taking decision on said transfer application of the petitioner.

Hence, no relief can be granted to the petitioner. Writ petition stands dismissed.

However, this order shall not preclude the petitioner to apply for transfer if pupil teacher ratio is improved in the school in question.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
