Learned counsel for the petitioner submits that the restoration of electric connection sought by the petitioner has not been granted by the CESC Limited till date. Learned counsel for the CESC Limited submits that the disconnection, if any, was not effected by the CESC at all. That apart, it is alleged that the petitioner is already enjoying electricity at the same premises from another meter, standing in the name of a third person. Learned counsel for the petitioner controverts such contention and submits that such connection, which was previously enjoyed by the petitioner, has been cut off since long.

However, it appears from the materials-on-record that an objection has been taken by the CESC Limited to the restoration of electric supply as per the request of the petitioner on the ground of apprehended splitting of load. In such view of the matter, since the extant Regulations provide an authority in the form of a Grievance Redressal Officer for settling such disputes,

WPA 7581 of 2021 is disposed of by granting the petitioner liberty to approach the concerned Grievance Redressal Officer with the same reliefs as claimed in the present writ petition.

The petitioner shall make such approach within seven days from date. If so approached, the Grievance Redressal Officer shall, upon giving adequate opportunity of hearing to all the interested sides, decide the same in accordance with law as expeditiously as possible, preferably within four weeks from the approach being made.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
