The present revisional application has been preferred challenging the proceeding being C.R. Case No.66 of 2011 pending before the learned ACJM, Arambagh.

The petitioner was aggrieved in respect of the warrant of arrest so issued by the learned court in respect of a proceeding under Section 500 of the Indian Penal Code.

I have considered the allegations made in the petition of complaint and the documents on the foundation of which Process has been issued against the bank.

Having regard to the same, I am of the opinion that the trial of the case should continue. No interference is called for at this stage.

Accordingly, CRR 522 of 2013 is dismissed.

Pending application, if any, is consequently dismissed. Interim order, if any, is hereby vacated.

However, if an application under the relevant section of law is made for dispensing with the personal appearances of the accused persons and application under Section 305 of the Cr.P.C. is

made on behalf of the bank, learned Magistrate will consider the same in accordance with law.
