For the Petitioner Mr. Suman Ghosh Mr. Siddhartha Ghosh .... For the State Learned counsel for the petitioner submits that the petitioner is the hapless father of the victim who was murdered. The allegation of the petitioner is that he was murdered by his wife and members of his matrimonial family. As a counter blast, a subsequent complaint was lodged falsely implicating a relative of the petitioner under the POCSO Act. The petitioner was threatened by the accused and their associates to withdraw the complaint lodged by him and was attacked with dangerous weapons for which he lodged a subsequent complaint on 30th January, 2025.

Learned counsel for the State submits that chargesheets have been submitted in connection with the complaints lodged by the petitioner and the subsequent complaint lodged under the POCSO Act. The complaint lodged by the petitioner on 30th January, 2025 has been registered as FIR and the investigation is in progress. Learned counsel submits that the son of the victim who was in custody of the Child Welfare Committee has been taken back by his mother after being released on bail.

Learned counsel for the petitioner seeks a fair and unbiased investigation of the subsequent complaint lodged by him. He seeks to produce a videograph as well as relevant documents before the investigating authority to substantiate the allegation.

In view of the gravity of the offence alleged and also since the petitioner has been allegedly facing threats from the accused to withdraw the complaint, investigation of the subsequent complaint lodged by the petitioner which has been registered as Chanchal Police Station Case no. 112 of 2025 dated 31st January, 2025 be monitored by the Superintendent of Police, Malda being the 4th respondent herein who shall ensure a fair and unbiased investigation and take the same to its logical conclusion in accordance with law. The petitioner shall produce the videograph as well as the other relevant documents before the 4th respondent at the earliest.

In the meantime, interim protection granted to the petitioner vide order passed on 11th April, 2025 shall continue.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
