Affidavit of service filed by the petitioners is taken on record.

On prayer of the petitioners, liberty is granted to expunge the name of the 7th respondent from the cause title of the writ petition.

The cause title of the writ petition be amended accordingly.

The petitioners claim to be recorded owners of the plot in question by virtue of inheritance from their predecessor-in-interest and submit that the plot was acquired by the Border Security Force who paid compensation for the same to the State of West Bengal. The petitioners complain that the compensation amount has not been disbursed to them by the State till date. The petitioners submitted a representation in this regard before the District Magistrate, Uttar Dinajpur, being the 2nd respondent herein, on 28th February, 2022 which is yet to be considered. The petitioners pray for a direction upon the concerned authority to consider the representation at the earliest.

Upon consideration of the submission made on behalf of the parties, the writ petition being WPA 6348 of 2022 is disposed of directing the 2nd respondent to consider and dispose of the representation submitted by the petitioners dated 28th February, 2022 within two months from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
