Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case for alleged recovery of 161.280 kgs. of ganja. The investigation has already been concluded and chargesheet has been submitted before the jurisdictional court. However, charges have not been framed till date. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.
Having considered that the petitioner has failed to overcome the rigors of Section 37 of the NDPS Act, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.
The application for bail, being CRM (NDPS) 578 of 2026, is, thus, dismissed.
