No.32 CRR 799 of 2021 In the matter of : Gopal Dutta Mr. Sumanta Das ...for the Petitioner This is an application seeking an expeditious disposal of a proceeding under Section 138 of the Negotiable Instruments Act. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the complainant in this case. Although the petition of complaint was filed in November 2018, till date the proceeding could not be concluded. After obtaining bail in January 2020, the accused prayed for several adjournments. Long dates are being fixed in this case. Till date, even plea could not be recorded. The case has remained pending for no fault on the part of the petitioner. I have heard the submissions of the learned counsel appearing on behalf of the petitioner and have perused the revision petition. No prejudice would be caused to any one if a direction is passed for an expeditious disposal of the case.

It appears that some delay was occasioned in concluding the impugned proceeding.

In view of the above, and in the interest of justice, I request the learned Trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and keeping in mind the statutory stipulation for expeditious disposal of a case as contained in Section 143(3) of the Negotiable Instruments Act.

With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, is to be given to the parties upon usual undertakings. (Jay Sengupta, J.)
